Report Corruption

If you become aware of one or more violations of the Law of Ukraine “On Prevention of Corruption” committed by employees of the State Agency for Restoration and Infrastructure Development of Ukraine, namely:

  • failure to prevent or resolve a conflict of interest;
  • violations of gift restrictions as defined in Article 23 of the Law;
  • violations of restrictions on close relatives working together as defined in Article 27 of the Law;
  • violations of the rules on combining public service with other types of activity as defined in Article 25 of the Law;
  • failure to comply with legislation on ethical behavior;
  • violations of financial control obligations, as defined in Articles 45–46 and 48–52 of the Law;
  • violations of the requirements for organizing work to prevent and detect corruption;
  • violations of the requirements for conducting a special background check as defined in Article 56 of the Law;
  • or any other violation of the Law.

You can submit a report with or without disclosing your identity

 Are you a whistleblower? What does that mean?

According to the Law of Ukraine “On Prevention of Corruption,” a whistleblower is a natural person who, based on a reasonable belief that the information is reliable, reports potential facts of corruption or corruption-related offenses or other violations of this Law committed by another person, if the information became known to them in connection with their employment, professional, business, civic, or scientific activities, public service, or education, or through participation in legally mandated procedures required for starting such activities or service.

 

A person is considered a whistleblower if the following conditions are met: 
  • The report is submitted by a natural person (Ukrainian citizen, foreign national, or stateless person) who reasonably believes the information is accurate;
  • The report contains verifiable facts indicating a possible corruption offense committed by another person;
  • The information was obtained through the person’s job, professional, or other relevant activities.

If at least one of these conditions is not met, the person is considered an informant rather than a whistleblower.

When do you become a whistleblower?

 A person obtains whistleblower rights from the moment they submit a report.

Important:

Knowingly submitting false information may lead to liability as prescribed by Ukrainian law.

Your Rights and Guarantees as a Whistleblower

You have the right to:
  • Receive information on the status and outcome of the report review;
  • Submit evidence, provide explanations or testimony, or decline to do so;
  • Receive free legal assistance in connection with protecting your rights as a whistleblower;
  • Be reimbursed for expenses related to protecting your rights, including lawyer’s fees and court costs;
  • Confidentiality and anonymity;
  • Personal safety, as well as the safety of close relatives, property, and housing in case of threats to life or health—or to decline such protection measures;
  • Receive a reward (under Article 53-7 of the Law of Ukraine “On Prevention of Corruption,” a whistleblower may receive 10% of the monetary value of the corruption offense or the damage caused to the state, after a guilty verdict is issued. The reward cannot exceed three thousand minimum wages as defined at the time the offense was committed);
  • Receive psychological support;
  • Be exempt from legal liability in specified cases.
Guarantees Provided to Whistleblowers:

A whistleblower is protected against dismissal or forced resignation, disciplinary action, or any other negative consequences (such as demotion, reassignment, denial of promotion, salary reduction, etc.) due to their report. If such rights are violated, they may be entitled to compensation for lost wages and damages.

Where to turn if your rights are violated:

Authorized anti-corruption unit of the Agency for Restoration

To ensure protection against the application of adverse actions by a supervisor or employer;

National Agency on Corruption Prevention

To ensure legal protection, monitor compliance with whistleblower protection laws, issue binding orders to eliminate rights violations, and hold offenders accountable.

Law enforcement authorities

To protect life, health, housing, and property

You are entitled to free secondary legal assistance. To receive it, a whistleblower must apply to the Free Legal Aid Center or the territorial office of the Ministry of Justice (based on actual place of residence). The application must be accompanied by documents confirming the submission of a whistleblower report regarding possible corruption or corruption-related offenses.

Examples include: 

A copy of the Agency for Restoration’s response to the report;

A copy of the letter on preliminary findings from the Agency for Restoration;

A copy of a notification to the NACP on the start of a pre-trial investigation involving the whistleblower;

Or other documents issued by authorized bodies confirming the person’s status as a whistleblower.

What happens after you submit a report?

The preliminary review of the information provided in your report takes up to 10 working days from the date the information is entered into the Unified Whistleblower Reporting Portal.

Within 3 days after the completion of the preliminary review, the person who submitted the report will be informed of the possible outcomes:

If the report contains facts of corruption or corruption-related offenses, the Agency for Restoration will notify the competent anti-corruption authority in writing within 24 hours, such as the Prosecutor’s Office, National Police of Ukraine, National Anti-Corruption Bureau of Ukraine, or National Agency on Corruption Prevention (NACP).

  • If the report concerns the actions or inaction of the Head of the Agency for Restoration, it will be forwarded within 3 days to the competent body authorized to consider or investigate the facts stated in the report.

If signs of a corruption or corruption-related offense are identified, the materials will be transferred to the appropriate anti-corruption authority or to the State Bureau of Investigations.

If the preliminary review confirms the information in the report, the responsible persons will be held disciplinarily liable through a disciplinary procedure (internal investigation).

The duration of the disciplinary procedure (internal investigation) is no more than 30 days from the completion of the preliminary review. If it is not possible to verify the reported information within this time, the disciplinary procedure may be extended once for up to 45 days.

The person who submitted the report will be provided with detailed information about the outcome of the disciplinary procedure (internal investigation) within 3 days from its completion.
